The legal morass sparked by the beating of a federal inmate at the hands of two Chattanooga police officers has stretched over nearly a year, but city officials hope to end it by Jan. 1.

A settlement has been reached with Adam Tatum, who suffered two broken legs in the beating and had sued the city for million. On Monday, Tatum agreed to drop his federal lawsuit in exchange for 5,000.

Still pending are two lawsuits, one filed by Sean Emmer and Adam Cooley, the officers fired over the beating, and a city appeal of a judge’s decision ordering the Chattanooga Police Department to reinstate them.

City Council Chairman Yusuf Hakeem said Tuesday that he sees an effort on the city’s part to resolve the entire case by the first of the year.

Attorneys on both sides of the case said they couldn’t comment on whether a settlement was in sight for the other cases.

It took nine hours of mediation on Monday to reach an agreement on Tatum’s lawsuit. Tatum attorney Robin Flores said the city will pay 2,500 of the amount, Erlanger hospital will pay ,500 and the remaining ,000 is coming from an undisclosed source.

Tuesday night, the City Council unanimously approved the city’s payment.

The incident occurred on June 14, 2012, when police responded to a call from the Salvation Army halfway house at 800 McCallie Ave.

Video footage showed that Tatum brandished a knife and began kicking the door of an office in the building. When officers arrived, Tatum resisted arrest.

He was beaten with batons and shot with pepper spray. By the time it was over, he had a broken nose, black eyes and multiple breaks in both legs.

Chattanooga police Chief Bobby Dodd fired Emmer and Cooley in November 2012 for using what he called excessive force.

Flores filed the million federal lawsuit against the city in January 2013. He later added nearly two dozen other police officers to the filing.

The officers’ lawyers argued that the pair followed proper procedure and showed that Tatum was on cocaine at the time, armed with a knife and threatening other halfway house residents.

In September, an administrative law judge from Nashville ruled that the pair should be reinstated and receive back pay.

City officials appealed that ruling to Hamilton County Circuit Court and were granted a stay to not reinstate Emmer and Cooley. That lawsuit is still pending in Circuit Court, and no hearing date had been set as of Tuesday.

In November, Emmer and Cooley sued the city for 0,000 in a federal employment discrimination lawsuit claiming that the city imposed “an untrue and unjust stigma upon” them professionally and personally, which has “denied them the freedom to take advantage of other employment opportunities.”

That lawsuit was still pending Tuesday.

Federal authorities found no prosecutable offenses against the pair. A Hamilton County grand jury declined to indict the policemen, and an administrative law judge ordered that they be reinstated to their jobs after a three-day hearing.

Flores said his client wanted to end the ordeal, and he commended city officials for being willing to resolve it without a trial.

Former FBI special agent Jim Clemente features in a two-part series to mark the 20th anniversary of her death

It’s the 20th anniversary of the brutal murder of six-year-old JonBenet Ramsey , and the family have been back in the spotlight after previously being suspects in the investigation.

The child beauty queen was found beaten and strangled after being sexually assaulted in the basement of her family home after her mother found a bizarre ransom note from the murderer asking for money.

New documentaries aired this month have taken another look at the unsolved crime, and now former FBI special agent Jim Clemente has spoken out in one programme.

He gathered a team of experts to analyse the evidence once again, and they agree upon the identity of the person they think murdered her.

We all came to one complete theory that explains everything that happened,” Mr Clemente told news.com.au. “When a six-year-old innocent girl is killed and never got justice, that case is going to bother you. It bothers me.

“The world has heard so many false rumours. The people of the community need to know the truth so they can put pressure on the district attorney. We really want this case to be solved.

“It’s important for her to be able to rest in peace.”

Mr Clemente will feature in the two-part series, The Case Of: JonBenét Ramsey, which premieres tonight on Channel Nine in the US and will reveal their theory.

The analysts will take another look at the suspects, including Gary Oliva, 52, who was found with a photo of JonBenet in his backpack in December 2000, along with a stun gun.

It has been believed that she was silenced with a stun gun and the doc will look at evidence given over the years.

Michael Helgoth, whose family owned a junkyard in the city, will also be discussed, along with her brother Burke, who was nine at the time of her death, and gave an awkward interview with Dr Phil last week .

Mr Clemente said it was “irresponsible to try to do a personality assessment from a TV interview,” but instead looked at interviews and behaviour over the past 20 years.

According to reports, it told them “a tremendous amount more” about the case, which will be revealed in the show.

“She was exposed to more people in the world,” said Mr Clemente. “Most six-year-olds live sheltered lives, she was out there in public, in parades … she could have been noticed by a sexual offender.”

JonBenet’s brother Burke has also spoken out for the first time about his sister’s death, giving an interview to American TV show Dr. Phil – the third installment is set to air this evening in the US.

Georgia Home Invasion 911 Call: ‘She’s Shooting Him’

LOGANVILLE, GA (CBS ATLANTA) –

CBS Atlanta News has uncovered new details regarding a home invasion in Loganville on Friday.

Walton County investigators said the homeowner involved wasn’t the only target and released the chilling 911 call from the incident.

“Melinda, if he opens that door you shoot, you shoot him, you understand?” the victim’s husband, Donnie Herman, could be heard saying to his wife on the 911 call.

Donnie Herman called 911 just seconds before a man broke into his home where his wife and two children were hiding in a crawl space.

“She shot him, she’s shooting him. She’s shooting him, she’s shooting him,” Donnie Herman said in the call.

Donnie Herman wasn’t at home, but he had his wife on one line and the police on another.

Investigators said Paul Slater pried his way into the family’s home on Henderson Ridge Lane.

According to authorities, he used a crowbar to bust open three doors inside the home as he chased Melinda Herman and her children.

Herman then shot Slater five times with a .38 caliber handgun.

“Shoot him again, Shoot him,” Donnie Herman said over the phone.

Police told CBS Atlanta News that Slater approached another homeowner up the road about 15 minutes prior to the crime.

“He just drove into the driveway as if he knew where he was going and then I saw him drive up and I walked out and asked him what he needed,” said homeowner Anita Brown. “He didn’t really have any answers. He said he was looking for a coach Williams, who doesn’t live anywhere around here.”

Investigators said Slater is on a ventilator after being shot and the case is still under investigation.

“We own guns, we keep them, and if (he) would have made it into the house I can’t say I wouldn’t have done the same thing,” Brown said.

A would-be burglar was looking to cash in, but instead found himself in a world of pain when a Georgia mother who refused to be victimized shot him multiple times in the face and neck.

The Loganville woman, who was not identified, was in the home with her 9-year-old twins on Friday afternoon when someone began ringing the doorbell.

Thinking it was just a door-to-door salesperson, she didn’t answer.

But after the ringing persisted, the person began prying the door open with a crowbar.

She quickly retreated to an attic crawlspace with the children, but not before she also picked up her handgun.

The burglar, whom police identified as Paul Ali Slater, did a room-by-room search of the home, and when he reached the attic, she was ready.

Walton County Sheriff Joe Chapman told WSBTV: ‘The perpetrator opens that door. Of course, at that time he’s staring at her, her two children and a .38 revolver.’

She reportedly fired all six rounds, missing only once. The other shots hit Slater about the face and neck.

Sheriff Chapman told the Atlanta Journal-Constitution: ‘The guy’s face down, crying. The woman told him to stay down or she’d shoot again.’

Slater did eventually get up and managed to return to his vehicle that was parked outside the home, but his injuries left him unable to drive, and it wasn’t long before he crashed into a wooded area.

He was found by sheriff’s deputies, bleeding heavily in a driveway on the block.
